IAM District 19 Press Release

Approximately 4,900 members of the International Association of Machinists and Aerospace Workers (IAM) District 19 have voted to accept the latest Tentative Agreement with the National Carriers’ Conference Committee (NCCC).

IAM District 19 released the following statement:

“IAM District 19 members have accepted the Tentative Agreement. We are confident that this is the best deal for our members. District 19 leadership worked day and night to communicate the agreement’s benefits and what would happen if it was rejected.

“With 59% of the membership participating in the vote, the agreement was ratified with 52% of voting members accepting the agreement.

“Our union recognizes that the agreement wasn’t accepted overwhelmingly, so our team will continue conversing with our members at our rail yards across the nation. This agreement is the first step in addressing some of the issues in our industry. Our fight was able to shine a light on the work-life balance issues as well as the lack of proper paid sick leave. Our union will continue to amplify the deficiencies in the carriers’ sick leave and attendance policies. We want to thank IAM International President Robert Martinez Jr. for his steady leadership and counsel throughout this process.

“We look forward to sitting down with the carriers to find a solution to the overtime policies in our industry. The IAM is grateful for the support of President Biden, Secretary of Labor Walsh, and other allies for creating the space that allowed us to work towards a solution for our members. This agreement is essential in giving our members the respect and dignity they have earned during their careers.”

Highlights of the improved Ratified Agreement include:

  • A Cap in Healthcare Costs: A monthly Health and Welfare Plan employee contributions limit to no more than $398.97 through 2025 until a new agreement is reached.
  • Single Room Occupancy: For the first time, we will have codified language in our agreement requiring your employers to provide roadway mechanics with their own sleeping rooms while on travel. Previously, this could have been changed by the employers without further negotiation.
  • Travel Expenses and Per Diem: The carriers have agreed to bargain with us within 60 days of ratification over travel expenses and per diem.
  • Overtime: For the first time, we also got the carriers to agree to a joint study on overtime, forced overtime policies, and overtime meal options.
  • A 24% compounded general wage increase.
  • A $5,000 service recognition bonus.
  • Full retroactive pay, within 60 days of contract ratification.
  • An additional paid day off for all members, including a paid day off for all newly hired employees hired before September 30 of each year.
  • Enhanced hearing benefits and added coverage for diagnosis and treatment of Autism Spectrum Disorder.
  • A “Me-Too” clause ensures IAM Rail Division members will receive the same additional value if another union reaches an agreement that improves the terms of this agreement.

IAM District 19 represents Locomotive Machinists, Roadway Mechanics, and Facility Maintenance Personnel at NCCC freight rail carriers.

Dear IAM District 19 Members:
Throughout this process of seeking a new contract, you have stood strong and demanded the fair treatment you deserve from the carriers. Your solidarity and strength have made national headlines and, most importantly, given your District 19 negotiating team the power we need at the negotiating table to make the carriers listen to your needs.
Today, we are proud to report that after another round of tough negotiations, we have reached an improved Tentative Agreement with the National Carriers’ Conference Committee (NCCC). Highlights of the improved Tentative Agreement include:
A Cap in Healthcare Costs: A limit of monthly Health and Welfare Plan employee contributions of no more than $398.97 through 2025 until a new agreement is reached.
– Single Room Occupancy: For the first time, we will have codified language in our agreement that will require your employers to provide roadway mechanics with their own sleeping rooms while on travel. Previously, this could have been changed by the employers without further negotiation.

We also secured everything from the first Tentative Agreement, including:
– A 24% compounded general wage increase
– A $5,000 service recognition bonus
– Full retroactive pay, within 60 days of contract ratification, amounting up to $11,950, based on average pay hours (overtime and straight time)
– An additional paid day off for all members including a paid day off for all newly hired employees hired before September 30 of each year
– Enhanced hearing benefits and added coverage for diagnosis and treatment of Autism Spectrum Disorder
– A “Me-Too” clause, ensuring IAM Rail Division members will receive the same additional value if another union reaches an agreement that improves the terms of this agreement.
In another measure to grow our strength, the cooling off period will now put IAM District 19 members back on schedule with many other rail unions. The new cooling off period will expire on December 9, 2022. In the meantime, we continue to work with coalition partners to secure the best deal possible.
As always, IAM District 19 members will have the final say in this improved Tentative Agreement. Ratification vote details will be shared with every member soon. The IAM District 19 Leadership Team will soon be visiting shops from coast to coast and looks forward to answering your questions.

Negotiations planned for May 6 and 7, 2020 were canceled. Negotiations were presumed to take place on June 15, 2020, However, nothing developed. Carriers are trying to shift significant cost of healthcare plan to employees and reduce benefits to our members. The way negotiations will proceed are undetermined at this point. They will be either face to face or through video conferencing. The Coalition has unanimously decided that face to face negotiations is the appropriate path for something so critical.

NATIONAL FREIGHT AGREEMENT:

Our Coalition had our initial Negotiation session with the Carriers in December 2019. There were no proposals exchanged during this meeting. However, the Carrier hinted, that without a quick agreement, mediation was their preferred path to take. The Carrier’s believe the National Mediation Board is on their side. Remember, President Trump appointed the two most anti-union, anti-labor, board members in history of the NMB. Our next session will be held on February 26 and 27 in Washington, DC. There will be an update shortly after that meeting.

This round of negotiations has been the toughest that I have seen in my 25 years on the Railroad. With the 5-7% drop in car loading’s, the Carrier believes furloughs must happen to stay competitive in the rail business. Norfolk Southern and Union Pacific have both said there will be more furloughs throughout this year. To show the seriousness of our current situation, just in the past couple of weeks, NS furloughed 48 and UP furloughed 46 of our fellow working Machinists. A devastating blow to these members and their families. Unfortunately, the Trump Administration is on the Carrier’s side and not on the hardworking employees who do the actual work that truly makes the industry thrive. This Administration is clearly not offering up any help to us. Thankfully, we have a large coalition that is committed to stand by each other and fight with all we have against this corrupted management style.

Know this staff is dedicated to the membership and is working hard to make this District the best District ever.

Rail Chiefs announce formation of Coordinated Bargaining Coalition

Top leaders of 10 rail unions announced today that their organizations will be participating in coordinated bargaining in the round of national negotiations that began on November 1, 2019.  The unions comprising the Coordinated Bargaining Coalition are:
• American Train Dispatchers Association (ATDA)
• Brotherhood of Locomotive Engineers and Trainmen / Teamsters Rail Conference (BLET)
• Brotherhood of Railroad Signalmen (BRS)
• International Association of Machinists (IAM)
• International Brotherhood of Boilermakers (IBB)
• National Conference of Firemen & Oilers/SEIU (NCFO)
• International Brotherhood of Electrical Workers (IBEW)
• Transport Workers Union of America (TWU)
• Transportation Communications Union / IAM (TC
• Transportation Division of the International Association of Sheet Metal, Air, Rail, and Transportation Workers (SMART–TD)
Jointly, the Coordinated Bargaining Coalition unions represent more than 105,000 railroad workers covered by the various organizations’ national agreements and comprise over 80% of the workforce who will be impacted by this round of negotiations.

We are currently working to prepare our Section Six Notice that will be served on Carriers subject to the National Agreement.  Section Six notices are used in notifying the Carriers that we want to amend our present Agreement and is the first step in the negotiating process.  The results of the National Agreement survey are playing an important role in forming our IAM District 19 notice.   Our Section Six notice will encompass some of the amendments we are seeking, but not necessarily all of them.   We are not restricted to just negotiating the amendments we have listed in our Section Six Notice; we can amend our Section Six notice and propose amendments to any part of the Agreements we deem need to be changed.
Section Six Notices can be served upon the Carriers on or after November 1, 2019.  Local Lodges will receive a copy of our Section Six Notice to be shared with the membership once it has been finalized.

Since the beginning of this year I have been talking about the need to restructure District 19. Recently seventeen (17) Local Lodges were merged into other Local Lodges.  The District has gone from seventy-five (75) Local Lodges to fifty-eight (58).  This is the start of our restructuring plan.  Our next step, and in the very near future, a General Chairman will be assigned to Local Lodges to oversee the operations of the Lodge.   They will also be providing guidance and help with the operation of their assigned Locals.  Each General Chairman will have 4-7 Locals that they will be responsible for. In addition to the help and guidance, this will allow the General Chairmen more opportunity to attend Local Lodge meetings on a regular basis.  It is my goal to have, and it is important that all District 19 Local Lodges operate within the IAMAW Constitution, District and Local Lodge Bylaws.
The members of Local Lodge 2741, Hornell, NY who work for Alstom, are featured in the fall IAMAW Journal.   One of our own District Lodge 19 and Local Lodge 2741-member, Sister Sadie Payne. She is featured on the front cover of the IAMAW Journal.  Please visit https://www.goiam.org/news/latest-videos/a-railroad-tradition/  to hear her story and from other Local 2741 members.  I believe this is the first time that a District 19 member has been featured in the IAMAW Journal let alone the fact that we have Sister Sadie on the front page.  The members of 2741 take great pride in their work for Alstom, and exceptional pride in being IAMAW District Lodge 19 members.
The (click to read the) 2019 3rd Quarter President’s Report  has been sent via US mail and email to all Local Lodge Presidents, Recording Secretaries and Local Chairmen.   The report has also been sent via email and US Mail to the Executive Board Members.  Please read this report at your next Local Lodge meeting and please post on Workplace union bulletin boards.  This report may be copied and shared with all the members.
